2. When Is an Inventory Search Lawful in Maryland?


To be legal, two conditions must be satisfied:


  1. Lawful Impoundment


    • The vehicle must be impounded for lawful reasons—such as arrest, traffic violations, or public safety hazards.


  2. Following Standardized Police Procedures


    • Officers must follow a written department policy that outlines how and where inventory searches are conducted.

    • The search can’t be arbitrary or a pretext for an unrelated investigation.
