Assateague Island National Seashore is one of Maryland’s treasures — a place where families, campers, and beachgoers come to enjoy the wild ponies, the waves, and the natural beauty of the Eastern Shore. But many visitors don’t realize that Assateague National Seashore is federal land, and that means being charged with Driving Under the Influence (DUI) here is very different than on state roads in Ocean City, MD or Berlin, MD.
If you are arrested for DUI at Assateague, you are facing federal charges, and that requires specialized defense.

Why a DUI at Assateague Is Different
Unlike a DUI stop in Ocean City or Worcester County, Assateague falls under federal jurisdiction. That means:
You will be charged under federal law, not Maryland state DUI law.
Cases are handled in federal court in Baltimore, not the local Worcester County courthouse.
Federal prosecutors are often less flexible, and penalties can be harsher.

What Penalties Could You Face?
If you are charged with DUI on Assateague Island, potential penalties may include:
Fines up to $5,000
Up to 6 months in federal prison
A permanent federal criminal record
Loss of driving privileges (in Maryland and potentially your home state)
These are serious consequences that can impact your freedom, your employment, and your future.

What Should You Do If Charged?
Do not ignore the charge — even though it happened at a beach or campsite, this is a federal offense.
Consult an experienced defense attorney immediately — federal court has its own procedures, and you need a lawyer familiar with both local and federal law.
Protect your rights from the beginning — anything you say to rangers or investigators can be used against you.

Frank's Advice
I just recently handled a Federal DUI that occurred at the Federal park on Assateague Island. Although the result was good, the big take away was at the Federal level, there is no-such thing as probation before judgement. It also should be noted that if you refuse to take the breath test at the police station you will be charged with a separate charge of not taking the breath test and that penalty can be up to 6 months in jail. So don’t drink and drive but if you make that mistake at the Federal Park on Assateague island call me I’m admitted in Federal Court and I can help you! Call me!
